Procedure of transshipment of grain

Sequence of procedures of the exporters when shipping grain via Ak Biday -Terminal JSC (Aktau port)

The terms used:

Terminal – Ak Biday-Terminal JSC-the grain terminal, located on the territory of the National Company Aktau International Sea Trade Port JSC. The terminal is located in the area of operation of the relevant division of the State revenue committee.

Grain (cargo) – the commodity for export, with the qualitative characteristics complying with the standards, provided for by the legislation of the RoK, delivered to the Terminal by shipload lots in sealed railcars-grain carriers. Each lot shall go with the set of Cargo Customs Declaration and shipping documents.

Exporter - owner (seller) of grain. The Exporter has the right to independently perform all the procedures on export and transshipment of grain at the Terminal, including forwarding of the railcars, or entrust the Representative (representatives), authorized with the right to represent his interests to act on his behalf and on the instructions of the exporter of grain, in accordance with the legislation of the RoK.  

The forwarder - is an exporter agent or his forwarder, which provides a full range of services for the organization of grain transportation from the elevator to the vessel in the port (customs clearance, certification, allocation and forwarding of cars, the organization of transshipment, freight, etc.) and organizes the transportation of grain on the site from Aktau Port station to the ship in Port, including organization of customs clearance, bills of lading, cargo manifests and certificates, and freight forwarding on the railroad tracks of KaskorTransServis JSC.

The international inspection company – the company which carries out an independent expertise, inspection and checking of cargo (including qualitative characteristics of grain) and carriers (railcars, vessels etc.). 

Surveyor  – the expert of the international inspection company, who carries out inspection of the vessels and cargo and gives conclusion about their condition and size. Besides, the surveyor consults the transporters and cargo owners, examines the procedure of checking-out, reviews certificates and documents etc.

Step 1.  Filing application to transshipment

Step 2. Concluding agreements in the port

Step 3. Ordering railcars and approval of the traffic of railcars-grain carriers

- Provides an application to JSC "NC KTZ" through the ACS DKR (automated control system "Contractual and commercial work") to obtain a Plan of cars (the number of allocated cars, the volume of grain, the station of shipment and destination).At the same time JSC "NC KTZ" self-aligns with the cars of the Plan of JSC "NC" AISCP "and JSC Ak Biday-Terminal, as well as the direction of the Plan of wagons for the execution of railway departments on shipping station and JSC "Astyk Trans";

Ak Bidai-Terminal JSC having reviewed the request, gives its permission or a justified refusal.

The reasons why the Terminal may not agree on the wagon plan:

- overloading of the Terminal’s capacities (absence of free capacities);  

- failure to comply with conditions of an Agreement for the transshipment of grain, namely the provision and coordination with the Terminal delivery schedule Cargo,coordination with Terminal supply ship date, as well as the responsibilities of the exporter posts the names of the vessel, its carrying capacity, the shipowner and the ship's agent at the port of Aktau;

- Under conditions of high demand for terminal services, in order to support domestic producers, with other things being equal, Ak Biday-Terminal JS may prefer those customers who have a Kazakhstan certificate of goods origin ST-KZ.

Step 4. Shipping of cargo from the grain reception site

4.1.

- sends a request to Astyk Trans JSC for allocation of the necessary quantity of railcars at the station (s), makes payment of the railway rates and additional fees, receives railway codes and transport instructions;   

- makes payment of the railway rates and additional fees, receives railway codes and transport instructions;  

- submits applications at the stations of unloading indicating the date of providing and quantity of railcars placed;

- carries out preparation of the set of product accompanying documents:

- road consignment on the car;

- certificate of origin (if applicable);

- phytosanitary certificate;

- test report;

- declaration of conformity safety EEC countries

4.3.

- customs clearance of goods for export at the shipping station, as well as the clearance of the goods declaration (DT);

- at least 2 weeks prior to the dispatch of the first batch of grain from the departure station reports JSC "Ak Biday-Terminal" schedule of grain deliveries and the filing date of the ship in the port of Aktau for loading of the consignment;

 

Step 5. Intake of cargo to the Aktau sea port:

5.1.

- sends a letter of inquiry to the  NC AISTP JSC to get the pass to the docks area to execute formalities on grain transshipment;

- in writing and no later than 48 hours after sending the grain shall send to the JSC "Ak Biday - Terminal" Register anticipated cars;

 

 

 

Registry wagons must contain: the name of the shipper, the consignee (purchaser), date of dispatch, name of departure station wagon numbers, railway bills and said to them grain weight

5.3

Exporter**

-  carries out payment of the cargo harbor dues and other expenditures related to the delivery of grain to the docks area;

 

Step 6. Cargo execution and transshipment at the Terminal

6.1.

Exporter **

- ensures credit clearance of the railcars at the Aktau port station;

 

6.2.

 

Exporter**

 

- ensures timely supply of wagons to the Terminal, cleaning, as well as the performance of shunting operations continuously throughout the unloading of wagons through KaskorTransService JSC with uninfected grain to the Terminal receiving device;

 

6.3.

Exporter**

- provides (before unloading wagons) transfer of grain samples taken from each car in the infestation of grain control laboratory;

 

6.4.

 

Exporter**

 

-provides export and processing of wagons in case of detection of contamination of grain;

 

6.5.

Terminal

-  carries out (in accordance with the agreement) acceptance of railcars-grain carriers of the exporter;

- carries out weighting of grain and directs into free silos;

- ensures presenting of the vessel for loading on the date agreed with the Terminal;

- allows the passage of the vessel boundary, customs and pest control;

- ensures examination of the holds of the vessel by the surveyor for its suitability for the transportation of grain;

- provides inspection phytosanitary inspection of the vessel;

- provides disinfestation of the holds after loading grain.

-implements a Preboot execution of grain and processing of shipping of shipping documents:

- cargo order;

- Full wagon load sheet;

- veterinary certificate;

- the declaration of goods;

- other documents provided for by the export contract (for example: certificate of the international inspection company);

- provides clearance for grain export and clearance of all goods accompanying shipping documents in accordance with the current legislation of the RK and the rules of international law.

 

6.10.

Terminal

Carries out shipment of grain to the vessel;

 

6.11.

Exporter**

Ensures fumigation of cargo aboard the vessel;

Ensures the final draft of the vessel;

 

6.13.

Exporter**

Draws up a bill of lading, cargo manifest, certificate number of kvantiti;

Ensures establishment of the committee (port administration, customs, border service and other), which checks the vessel before its departure from the port;

Forwarding the vessel to the destination.

It should be noted:

• value storage each ton of cargo at the grain terminal during the first ten (10) days of receipt is free;

• the cost of storing each tonne of cargo, ranging from the 11th (eleventh) to 30 (thirty) days of 10 (ten) tenge per ton, then the cost per day of storage, starting with 31 (thirty-first) and is 50 more days (fifty ) tenge per tonne per day of storage; 

• in case of non arrival of the ship at an agreed time and disagreement with Terminal later Exporter vessel arrival in addition to storing payment, pays the penalty fee in the amount of 150 (one hundred fifty) tenge per ton of cargo per day, starting with a pre-agreed date of arrival of the vessel.

Grain exporter may transship grain independently, without the shipping agent or through any other forwarding company.
